Welcome to Neervi Atelier! This document is an electronic record in terms of the Electronic Commerce Act 2006 (ECA) and consists of the Rules and Regulations, Privacy Policy, and Terms of Service for accessing or using the Neervi Atelier e-marketplace platform (hereinafter referred to as "Platform") available at www.neerviateliermy.easy.co
The owner of this Platform is Neervi Sarees Clothing, a company registered under the Companies Commission of Malaysia Act.
By using the Neervi Atelier platform, you agree to the following Terms of Service, which include all applicable policies, rules, and guidelines. By accessing or using the Platform, you agree to be bound by these Terms and the Privacy Policy. The terms "Neervi Atelier," "We," "Us," and "Our" refer to Neervi Sarees Clothing and "You" or "User" refers to any natural or legal person who has registered on the Platform.
User Account
Account Registration: To use the Platform, you must register for an account by providing accurate and complete information.
Confidentiality: You are responsible for maintaining the confidentiality of your username and password and are liable for all activities that occur under your account. Notify us immediately if you believe your account has been compromised.
Account Suspension/Termination: We reserve the right to suspend, terminate, or block access to your account if we determine that any information provided is false, incomplete, or violates our policies.
Services Provided
Neervi Atelier is an online boutique that offers a selection of Indian and Fusion ethnic wear products (collectively, "Products") from various designers and brands.
Products:
The sale and purchase of Products on the Platform are governed by the relevant policies such as the return, exchange, and shipping policies (which can be found on the Platform).
We do not guarantee the accuracy, completeness, or reliability of the product descriptions, pricing, or any other content on the Platform. The images and descriptions provided are for illustrative purposes only and may not be entirely accurate.
While we strive to maintain accurate stock levels, occasionally there may be discrepancies. If an item you ordered is out of stock, we will fulfill the available items and contact you to discuss whether you’d like to
Wait for the item to be restocked,
Exchange it for another item, or
Receive a refund for the out-of-stock product.
Product Availability: Ready Stock vs. Pre-Order
At Neervi Atelier, we offer two types of products: Ready Stock and Pre-Order. Please review the following details regarding dispatch timelines for both types of products:
1. Ready Stock Items
Description: Ready stock items are products that are already in our warehouse and available for immediate dispatch.
Dispatch Time: Ready stock items will be dispatched within 1 to 3 working days from the time your payment has been confirmed and processed.
Shipping: Once your order has been dispatched, you will receive a notification email with tracking information to monitor the shipment.
2. Pre-Order Items
Description: Pre-order items are products that are not yet in stock but are available for purchase before they arrive. These items are ordered specifically for you.
Dispatch Time: Pre-order items will be dispatched within 2 weeks (14 business days) from the date of your order, depending on the availability of stock from our suppliers.
Shipping: After dispatch, you will receive an email notification with tracking details for your shipment.
Important Notes:
Order Processing: If your order contains both ready stock and pre-order items, the ready stock items will be dispatched first, and the pre-order items will follow once they are available. You will be notified of this via email, and additional shipping charges may apply for separate shipments.
Delays: While we make every effort to meet the stated dispatch timelines, delays in the supply chain or unforeseen circumstances may affect the estimated dispatch date for pre-order items. We will notify you of any significant delays.
Refunds for Pre-Order Items: Pre-order items are subject to availability, and in the event that a pre-order item becomes unavailable or delayed beyond the expected timeframe, you will be contacted to arrange for either a full refund or an alternative product.
By making a purchase, you agree to the estimated dispatch times and acknowledge that pre-order items will take longer to arrive than ready stock items.
Payments
We offer bank transfer as a payment method for orders placed on Neervi Atelier. By selecting this payment method, you agree to the following terms:
Bank Transfer Instructions:
Once you have placed an order, you will receive the payment details, including the bank account number and instructions for completing the bank transfer.
Payments should be made directly to the provided bank account using your preferred bank.
Upload Proof of Payment:
After completing the bank transfer, you are required to upload the payment receipt during the checkout process in order to confirm your payment.
The receipt must clearly display the transaction details, including the amount, date, and your name (or order number) for verification.
Order Processing:
Your order will not be processed until we receive the payment receipt and verify the payment.
Once we confirm your payment, we will begin processing your order and notify you by email.
Payment Confirmation Time:
Please allow 1 to 2 business days for us to confirm your payment and process your order after uploading the receipt. Orders will not be processed during weekends or public holidays.
Unpaid Orders:
If we do not receive payment or the receipt within 12 hours from the order time and date, the order will be automatically canceled, and you may need to place a new order.
Payment Issues:
If you face any issues with your bank transfer or uploading the receipt, please contact us immediately at neervisarees@gmail.com. Our team will assist you in resolving any issues and ensuring your order is completed.
By choosing the bank transfer option, you agree to follow the above instructions and understand that your order will be processed only upon payment confirmation.
Shipping
1. Within Malaysia
Shipping charges will be calculated automatically during checkout, based on your total order amount and your shipping destination.We offer free shipping for orders within Malaysia over RM700. Please note that sales or promotional items are not eligible for free shipping.
2. International Shipping.
Import duties and taxes are assessed once the parcel reaches your destination country, and they are the responsibility of the recipient.Unfortunately, we do not have control over these charges as customs policies vary by country. We encourage you to check with your local customs office for details about potential duties and taxes before placing your order. If you refuse to pay the applicable duties and taxes upon arrival in your destination country, your goods will be returned to us at your expense. Please note that the cost of the initial shipping will not be refunded. For more information on customs charges, we recommend contacting your local customs office.Certain countries, such as India, may require additional documents (e.g., ID, passport, utility bills) for customs verification if the shipping address does not match the details on the provided identification. This is a standard procedure to ensure the safe delivery of parcels and prevent any misuse. If you are uncomfortable providing these documents, please contact the courier's customer service to verify the requirements. We are not liable for any inconvenience caused by this process, and no refund or compensation will be issued if you choose to cancel the order due to the customs procedure.
Delivery
1. We primarily use NinjaVan for deliveries within Malaysia and Aramex, TNT, DHL, or UPS for international deliveries. Once your order is processed, we will send you a tracking number and a link to track your parcel. Please note, customers are not permitted to select a specific courier unless they agree to pay any additional fees associated with the selected courier.
West Malaysia: Typically within 1-5 business days.
East Malaysia: Typically within 2-7 business days.
International Orders: Delivery can take anywhere from 20-30 days depending on the courier and destination.
Note: Delivery times may be extended during peak periods or due to unforeseen circumstances like Natural Disasters delays.
2. If you need to modify your order or shipping details, please email us at neervisarees@gmail.com or call us at +601116730116 within 1 hour of placing the order. Once the order has been dispatched, no changes can be made. If a second delivery attempt is required, additional postage fees may apply.
3. If the delivery time exceeds the expected timeframe, please contact us at neervisarees@gmail.com, and we will investigate the issue. Alternatively, you may contact the courier’s customer service for more information.
4. If your parcel is damaged or lost, please contact us immediately at neervisarees@gmail.com or call us at +601116730116. We will conduct an investigation with the courier. Please note, no refund or compensation will be provided unless the courier company compensates for the damage or loss.

General Conditions
Right to Refuse Service:
We reserve the right to refuse service to anyone, for any reason, and at any time. This includes the refusal of any order placed on our website.
Prohibited Actions:
You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the services, use of the services, or access to the services or any contact on the website without our express written permission..
Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of Malaysia.
Changes to the Terms of Service
We reserve the right to modify, add, or remove portions of these Terms of Service at any time. You should review this document regularly for any changes. Your continued use of the Platform after any modifications will constitute your acceptance of those changes.
